1. Acceptance of Terms

By downloading, installing, accessing, or using the Desenrola AI application ("App", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Use ("Terms", "EULA", or "Agreement"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Desenrola AI. By creating an account or using any feature of the App, you confirm that you have read, understood, and agree to be bound by these Terms.

These Terms apply to all users of the App, including the mobile application (iOS and Android), the custom keyboard extension, and any related services or websites.

2. Description of the Service

Desenrola AI is an AI-powered dating assistant that helps users write messages on dating platforms. The Service includes:

• AI Message Suggestions: The App uses artificial intelligence to generate message suggestions for conversations on dating platforms such as Tinder, Bumble, Hinge, and similar services.
• Custom Keyboard: A keyboard extension that integrates with your device, allowing you to receive AI-generated message suggestions directly within dating apps without switching between applications.
• Profile Analysis: The ability to analyze dating profiles (via screenshots or text) to provide contextually relevant conversation suggestions.
• Conversation Context: The App reads clipboard content (when you paste within the keyboard) to understand conversation context and generate appropriate responses.

The Service is designed to assist and inspire your conversations. It does not guarantee any particular outcome in your dating interactions.

3. Eligibility

If we discover or have reason to believe that a user is under 18, we will immediately terminate their account and delete all associated data. If you are a parent or guardian and believe your child has used our Service, please contact us immediately.

4. Account Registration

To use the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information;
• Maintain and update your account information to keep it accurate;
• Keep your login credentials confidential and secure;
• Accept responsibility for all activity that occurs under your account;
• Notify us immediately of any unauthorized use of your account.

You may not create multiple accounts, share your account with others, or transfer your account to another person without our prior written consent.

5. Subscription Terms and Billing

5.1 Subscription Plans

Desenrola AI operates on a subscription-based model. We offer the following auto-renewable subscription plans:

5.2 Auto-Renewable Subscriptions

All subscriptions are auto-renewable, meaning they will automatically renew at the end of each billing period unless you cancel before the renewal date. Key details:

• Payment is charged to your Apple ID account or Google Play account at confirmation of purchase;
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period;
• Your account will be charged for renewal within 24 hours prior to the end of the current period;
• The renewal price will be the same as the original subscription price, unless we notify you of a price change in advance.

5.3 Managing Your Subscription

You can manage and cancel your subscription at any time through your device's settings:

• Apple (iOS): Go to Settings > [Your Name] > Subscriptions > Desenrola AI > Cancel Subscription;
• Google (Android): Go to Google Play Store > Menu > Subscriptions > Desenrola AI > Cancel Subscription.

Canceling your subscription will stop future renewals, but you will retain access to the Service until the end of your current billing period. Deleting the App from your device does not automatically cancel your subscription.

5.4 Free Trial

We may offer free trial periods from time to time. If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. Any unused portion of a free trial will be forfeited when you purchase a subscription.

6. Refund Policy

All purchases and subscription payments are processed and managed by Apple (App Store) or Google (Play Store). Refund requests are handled entirely by Apple or Google in accordance with their respective refund policies:

• Apple: You may request a refund through reportaproblem.apple.com or by contacting Apple Support;
• Google: You may request a refund through the Google Play Store or by contacting Google Play Support.

Desenrola AI does not process payments directly and therefore cannot issue refunds. All billing inquiries should be directed to Apple or Google, as applicable.

7. User Responsibilities and Acceptable Use

By using Desenrola AI, you agree to the following:

7.1 General Responsibilities

• You are solely responsible for all messages you send to other people, whether or not those messages were suggested by the AI;
• You must comply with all applicable laws and regulations;
• You must comply with the terms of service of any third-party dating platforms you use;
• You are responsible for any consequences arising from your interactions with other people.

7.2 Prohibited Uses

1. Harass, stalk, threaten, intimidate, or abuse any person;
2. Send spam, unsolicited messages, or mass messages;
3. Engage in fraud, catfishing, impersonation, or deceptive behavior;
4. Send illegal, offensive, hateful, or discriminatory content;
5. Manipulate, deceive, or psychologically exploit other people;
6. Violate the privacy or rights of any third party;
7. Use the Service for any commercial or non-personal purpose;
8. Attempt to reverse-engineer, decompile, or disassemble the App;
9. Use bots, scrapers, or automated methods to access the Service;
10. Circumvent any security features or usage limits of the Service.

Violation of these rules may result in immediate suspension or termination of your account without refund and without prejudice to any legal action we may take.

8. AI-Generated Content Disclaimer

• All message suggestions provided by Desenrola AI are generated by artificial intelligence and are provided for informational and entertainment purposes only.
• AI-generated suggestions are not guaranteed to be accurate, appropriate, or effective in any given situation.
• The Service does not guarantee any results, including but not limited to matches, dates, responses, or relationships.
• AI suggestions do not constitute professional advice of any kind, including psychological, emotional, or relationship counseling.
• You are the sole decision-maker regarding whether to use, modify, or discard any AI-generated suggestion. You bear full responsibility for every message you send.
• The AI may occasionally generate content that is inappropriate, inaccurate, or culturally insensitive. You should always review suggestions before sending them.
• Desenrola AI does not endorse, encourage, or facilitate any form of harassment, manipulation, deception, or unlawful conduct.

9. Third-Party Services

Desenrola AI relies on the following third-party services to operate:

Your use of these third-party services is subject to their respective terms of service and privacy policies. Desenrola AI is not responsible for the practices, policies, or availability of these third-party services.

Desenrola AI is not affiliated with, endorsed by, or sponsored by any dating platform, including but not limited to Tinder, Bumble, Hinge, or Instagram.

10. Intellectual Property

10.1 Our Intellectual Property

All content, features, functionality, design, branding, logos, text, graphics, and software associated with Desenrola AI are owned by or licensed to us and are protected by intellectual property laws. This includes but is not limited to:

• The Desenrola AI name, logo, and branding;
• The App's design, user interface, and user experience;
• The underlying software, algorithms, and code;
• All documentation and marketing materials.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on our intellectual property without our prior written consent.

10.2 AI-Generated Content

Message suggestions generated by the AI are provided as a service to you. You may freely use, modify, and send these suggestions as part of your personal conversations. However, you may not:

• Systematically collect or aggregate AI-generated content for commercial purposes;
• Use AI-generated content to train other AI models or build competing services;
• Redistribute or publish AI-generated content in bulk.

10.3 Your Content

You retain ownership of any content you provide to the Service (such as profile information, conversation text, and screenshots). By submitting content to the Service, you grant Desenrola AI a limited, non-exclusive license to process that content solely for the purpose of providing the Service to you.

11. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the collection and processing of your data as described therein.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
2. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT IT WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.
3. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM THE USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO MATCHES, DATES, RESPONSES, OR RELATIONSHIPS.
4. IN NO EVENT SHALL DESENROLA AI, ITS OPERATORS, SERVICE PROVIDERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
   • Loss of data, revenue, profits, or business opportunities;
   • Emotional distress or moral damages;
   • Damages arising from AI-generated suggestions;
   • Damages arising from interactions with third parties;
   • Unauthorized access to or alteration of your data;
   • Any other matter relating to the Service.
5. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE 12 (TWELVE) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Desenrola AI, its operators, service providers, partners, and affiliates from and against any and all claims, demands, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service or violation of these Terms;
• Messages you send to other people, whether or not based on AI suggestions;
• Any content you submit, post, or transmit through the Service;
• Your violation of any third party's rights, including privacy and intellectual property rights;
• Your violation of any applicable law or regulation;
• Any dispute between you and another user or third party.

This indemnification obligation shall survive the termination of your account and your relationship with Desenrola AI.

14. Termination

14.1 Termination by You

You may stop using the Service and delete your account at any time. To fully terminate your relationship with Desenrola AI:

1. Cancel your subscription through the App Store (iOS) or Google Play Store (Android) settings;
2. Delete your account through the App (Settings > Account > Delete My Account) or by emailing us.

Remember that deleting the App does not cancel your subscription or delete your account. You must take both steps.

14.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or our Privacy Policy;
• Engaging in prohibited activities as described in Section 7;
• Fraudulent or illegal activity;
• Upon request by law enforcement or government authorities;
• Discontinuation of the Service.

14.3 Effect of Termination

Upon termination of your account:

• Your right to access and use the Service will immediately cease;
• We may delete your account data in accordance with our Privacy Policy;
• Any outstanding subscription will continue until the end of the current billing period (no prorated refunds);
• Sections of these Terms that by their nature should survive termination will continue to apply, including Limitation of Liability, Indemnification, and Intellectual Property.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top of this page;
• For material changes, we will notify you via email or through a notice in the App;
• Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.

16. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Desenrola AI regarding your use of the Service.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of our right to enforce it in the future.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets, with prior notice to you.
• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes arising from these Terms shall be resolved in the courts of the user's domicile, as provided by the Brazilian Consumer Protection Code, or, in the absence of a consumer relationship, in the courts of Sao Paulo, SP, Brazil.
